Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and World Basketball Scouting LLC ("World Basketball Scouting," "we," "us," or "our"), governing your access to and use of WorldBasketballScouting.com, including all associated content, tools, databases, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service. Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

1. Eligibility

The Service is intended for users age 13 and older. By using the Service, you represent that you are at least 13 years old. If you are between 13 and the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Accounts

You may need to register for an account to access certain features. You agree to provide accurate information, to keep it up to date, and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at the contact address below if you suspect unauthorized use of your account.

We reserve the right to suspend or terminate accounts, at our discretion, for violations of these Terms, misuse of the Service, or fraudulent, abusive, or unlawful activity.

3. The Service and Player Data

3.1 Nature of the Data

Player profiles on the Service are compiled from a combination of (a) direct submissions by players, teams, or authorized representatives through our Player Portal, and (b) publicly available sources such as federation records, club websites, and other public sports data. Roster information, rankings, offers, commitment status, contact information, and similar details are provided for informational and recruiting purposes only and may not reflect official or fully current data. Users should independently verify any information before relying on it for recruiting, eligibility, or other decisions.

3.2 Player Rights

Athletes (or their parent/guardian, if a minor) may claim, verify, correct, restrict, or request removal of their profile through the Player Portal's "Existing Prospect Form," as described in our Privacy Policy.

4. Prohibited Conduct

In addition to any other restrictions in these Terms, you agree that you will not, and will not permit or assist any third party (including any automated tool, bot, script, or artificial intelligence system) to:

  • Scrape, crawl, harvest, or extract data from the Service — including player profiles, statistics, rankings, contact information, images, video, or any other content — through automated means such as bots, scrapers, spiders, crawlers, data-mining tools, or similar technology, whether or not such tool respects robots.txt or rate-limiting measures;
  • Use, copy, or ingest any content or data from the Service — including player contact information and player profile data — to train, fine-tune, evaluate, or otherwise develop any artificial intelligence or machine learning model, including large language models, whether for commercial or non-commercial purposes;
  • Bypass, circumvent, disable, or interfere with any rate-limiting, access control, authentication requirement, CAPTCHA, or other technical measure we use to restrict or monitor access to the Service;
  • Access the Service through any interface other than the interfaces we provide (e.g., by directly querying our servers or database rather than using the website as intended);
  • Republish, redistribute, sell, sublicense, or commercially exploit player contact information, profile data, or any other database content obtained from the Service, whether scraped or accessed through a legitimate account, without our prior written consent;
  • Aggregate, compile, or create a derivative database or dataset from Service content for use outside the Service;
  • Reverse engineer, decompile, or disassemble any part of the Service;
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity;
  • Use the Service to violate any applicable law, or to infringe the rights of any third party, including privacy and intellectual property rights;
  • Interfere with or disrupt the integrity or performance of the Service, including through the introduction of viruses, malware, or excessive automated requests.

Notice to automated systems and AI agents: No license or permission is granted, expressly or impliedly, to any automated agent, crawler, scraper, or artificial intelligence system to access, copy, store, reproduce, or use any content or data from this Service for any purpose, including for training or improving any AI or machine learning system. This restriction applies regardless of whether such access nominally complies with technical exclusion protocols such as robots.txt, and applies independently of, and in addition to, any restriction stated in our robots.txt file or metadata tags.

We actively monitor for and may employ technical measures to detect and block scraping and unauthorized automated access. Violation of this Section is a material breach of these Terms and may additionally constitute a violation of applicable law, including the U.S. Computer Fraud and Abuse Act and analogous state and international laws. We reserve the right to pursue all available legal and equitable remedies, including injunctive relief, in the event of a violation.

5. Subscriptions and Payment

Certain features of the Service (such as ad-free browsing, advanced analytics/filtering, and access to enhanced player details) require a paid subscription. By purchasing a subscription, you agree to pay all applicable fees. Payments are processed either through our third-party payment processor or, for certain institutional customers, via direct invoicing. Fees are non-refundable except as required by law or as otherwise stated at the time of purchase. We may change subscription pricing prospectively with reasonable notice.

You are responsible for any taxes associated with your purchase, other than taxes based on our net income.

6. Intellectual Property

6.1 Our Content

The Service, including its design, software, compiled database structure, graphics, logos, and original written content (excluding underlying public-source facts and third-party content), is owned by World Basketball Scouting or our licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited right to access and use the Service as permitted under these Terms, no rights are granted to you in our content or trademarks.

6.2 Third-Party and Public Source Content

Certain data displayed on the Service originates from third-party or public sources (e.g., federations, clubs, ranking services). Such data remains the property of its original source where applicable, and is displayed under fair use, license, or other lawful basis. We make no claim of ownership over underlying factual data (such as an athlete's height or statistics) but do claim ownership over our compilation, organization, and presentation of that data as a database.

6.3 User Content

If you submit content to the Service (e.g., a player profile submission, highlight video, or questionnaire response), you grant World Basketball Scouting a non-exclusive, worldwide, royalty-free, transferable license to host, store, display, reproduce, and distribute that content for the purpose of operating and promoting the Service. You represent that you have the necessary rights to submit such content and to grant this license.

7. Third-Party Links and Services

The Service may link to or display content from third-party websites (e.g., federation sites, club pages, video platforms). We do not control and are not responsible for the content, accuracy, or privacy practices of third-party sites. Your use of third-party sites is at your own risk and subject to their own terms.

8. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT PLAYER DATA, RANKINGS, RECRUITING STATUS, OR OTHER INFORMATION ON THE SERVICE IS ACCURATE, COMPLETE, OR CURRENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOU USE THE SERVICE AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORLD BASKETBALL SCOUTING AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless World Basketball Scouting and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms, including Section 4 (Prohibited Conduct); (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) content you submit to the Service.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is harmful to our business interests. You may stop using the Service and, if applicable, cancel your subscription at any time in accordance with our cancellation process. Sections of these Terms that by their nature should survive termination (including Sections 4, 6, 8, 9, 10, 13, and 14) will survive.

12. Changes to the Service or These Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; if we make material changes, we will provide reasonable notice (such as a notice on the Service or via email). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Dispute Resolution; Arbitration Agreement; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

13.1 Agreement to Arbitrate

You and World Basketball Scouting agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or your use of the Service (a "Dispute") will be resolved through binding, individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court or seek injunctive relief in court for actual or threatened infringement, misappropriation, or violation of intellectual property or confidentiality obligations (including violations of Section 4, Prohibited Conduct).

13.2 Arbitration Procedure

The arbitration will be administered by a recognized arbitration organization (such as the American Arbitration Association) under its applicable rules, and will be conducted in Maricopa County, Arizona, or another mutually agreed location, or, if both parties agree, remotely or via written submissions. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

13.3 Class Action and Jury Trial Waiver

YOU AND WORLD BASKETBALL SCOUTING EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION. Disputes must be brought in your or our individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding.

13.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice to the contact address below within 30 days of first accepting these Terms. Your notice must include your name and a clear statement that you wish to opt out of arbitration.

13.5 Severability

If any part of this Section 13 is found unenforceable, the remainder of this Section will remain in effect, except that if the class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) must proceed in court rather than arbitration.

14. Governing Law

These Terms, and any Dispute not subject to arbitration under Section 13, are governed by the laws of the State of Arizona, without regard to its conflict of law principles. Subject to the arbitration agreement above, the state and federal courts located in Maricopa County, Arizona shall have exclusive jurisdiction over any Dispute not subject to arbitration.

15. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and World Basketball Scouting regarding the Service.
  • Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Force Majeure: We are not liable for delays or failures in performance resulting from causes beyond our reasonable control.
